Is Stress Leave Paid in Australia? Your Three Real Options

Is stress leave paid in Australia? There’s no separate “stress leave” law here. Instead, three real paths can pay you: personal leave, a workers compensation claim, or income protection insurance. Which one applies changes your outcome a lot. One of those paths also just got harder to access.

Quick Answer: Is Stress Leave Paid in Australia?

Yes, in most cases. It depends which path fits your situation. A permanent employee using accrued personal leave gets paid their normal wage. That works just like sick leave. If your stress links to a specific workplace event, a workers comp claim can pay weekly wages too. But from 1 July 2026, NSW tightened the psychological injury threshold. Income protection insurance typically covers around 75% of your income. Mental health cover still varies by insurer. Casual and self-employed workers usually have no paid personal leave at all.

Option 1: Paid Personal Leave

Stress isn’t a separate entitlement. It sits under paid sick and carer’s leave. The Fair Work Ombudsman confirms this directly. Full-time employees accrue 10 days of paid leave a year. Part-time employees get a pro-rata amount. Unused leave carries over each year. There’s no set minimum or maximum for a single absence. You can use your accrued balance as needed. You’ll usually need a medical certificate to show genuine incapacity.

This is the simplest path. Most people try it first. The catch is simple too: it only works if you’ve built up enough leave. Casual employees generally aren’t entitled to paid personal leave under the National Employment Standards.

Option 2: Workers Compensation for Psychological Injury

Is stress leave paid through workers comp? Sometimes, yes. If work caused your stress, a claim can pay your wages while you can’t work. It can also cover treatment costs. In some cases you may get a lump sum too. This path is harder than just using personal leave. It needs an insurer, medical proof, and a formal claim.

A real change now hits NSW workers. New rules start 1 July 2026, confirmed by the NSW Personal Injury Commission. A stress-related injury only gets paid if it stems from a “relevant event.” That event needs a real, direct link to your job. These events include violence or threats, serious crime, seeing a traumatic incident, and bullying or harassment. Excessive work demands count too. One line matters most here. The Commission says it plainly: a fair, reasonable action by your boss doesn’t count. A fair performance review won’t qualify. Neither will a properly run disciplinary process.

The pay threshold is rising in stages too. Claims made from 1 July 2026 need a 25% impairment rating at minimum. That climbs to over 26% for claims made from 1 July 2027. It climbs again to at least 28% from 1 July 2029. Workers rated at 21% can still get 52 extra weeks of lower payments. Medical cover usually ends 12 months after weekly pay stops. That cap only lifts if your rating tops 30%. The lump sum rule stays at 15%, unchanged by this reform.

Option 3: Income Protection Insurance

An income protection policy may cover stress-related illness. This applies whether you hold it on its own or through your super fund. It’s separate from any workplace claim. These policies typically pay around 75% of your normal income. Payments come as regular amounts, not one lump sum. Mental health cover varies a lot by insurer and policy. Some insurers won’t cover a prior mental health issue at all. Claims usually need a formal diagnosis, not just self-reported stress. Check your policy’s mental health terms first.
